SMS / RCS Messaging Terms of Service

Thrive POS ("we," "us," or "our"), powered by Thrive POS, offers an SMS/RCS messaging program that allows us to send you text messages related to your loyalty account, rewards, exclusive offers, promotions, order updates, and other communications relevant to your experience with us. By opting in to our SMS/RCS program, you agree to these SMS Terms of Service ("SMS Terms"), which are incorporated into and subject to our general Terms of Service and Privacy Policy.
1. How to Opt In
You may opt in to receive SMS/RCS messages from us by:
- Checking the opt-in box on our loyalty registration or sign-in page and providing your mobile phone number
- Texting a designated keyword (e.g., JOIN or YES) to our short code or long code number
- Any other opt-in method we explicitly make available
By opting in, you expressly consent to receive recurring automated marketing and transactional text messages from Thrive POS at the mobile number you provide. Consent is not a condition of any purchase.
2. Message Types
Messages you may receive include, but are not limited to:
- Loyalty point balances, rewards earned, and redemption reminders
- Exclusive member discounts and promotional offers
- Birthday and anniversary rewards
- Order confirmations and status updates
- New menu items and limited-time offers
- Re-engagement messages if your account has been inactive
- Program updates and changes to these SMS Terms
3. Message Frequency
Message frequency varies based on your account activity and the promotions offered by Thrive POS. You may receive up to 12 messages per month. We will always strive to send only relevant and valuable communications.
4. Messaging Rates & Charges
Message and data rates may apply. Charges are billed by and payable to your mobile carrier. Thrive POS and Thrive POS are not responsible for any fees charged by your mobile service provider. Please contact your carrier for details about your messaging plan.
5. Supported Carriers
Our SMS/RCS program is supported by most major U.S. carriers, including but not limited to:
- AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Cricket Wireless, Metro by T-Mobile, U.S. Cellular, and others.
Note: Coverage and compatibility may vary. RCS messaging requires a compatible device and carrier support. Messages may fall back to standard SMS when RCS is unavailable.
6. How to Opt Out
You may opt out of receiving SMS/RCS messages at any time by:
- Replying STOP to any message you receive from us
- Contacting us directly at sales@thrivepos.com or (800) 750-3947
- Updating your communication preferences in your loyalty account settings
Upon receiving your STOP request, we will send one final confirmation message:
"Thrive POS: You have been unsubscribed and will receive no further messages. Reply JOIN to re-subscribe at any time."
After opting out, you will receive no further promotional or marketing SMS messages. Note that you may still receive transactional messages related to an active order unless you contact us to opt out of those as well.

8. Privacy & Data Use
Your mobile phone number and messaging preferences are collected and stored securely. We will never sell or share your phone number with third-party marketers without your explicit consent. Your information is used solely to deliver the messaging services described herein and to improve your experience. 9. Platform Disclosure
SMS/RCS messaging services for Thrive POS are provided through Thrive POS. As the technology platform, Thrive POS facilitates message delivery on behalf of participating restaurants but does not independently market to your mobile number.
10. Eligibility
The SMS/RCS program is available to U.S. residents who are 13 years of age or older. By opting in, you confirm that you are the account holder or have the account holder's permission to subscribe using the provided mobile number. Enrolling a number that belongs to someone else without their permission is strictly prohibited.
11. Changes to These SMS Terms
We reserve the right to modify these SMS Terms at any time. If we make material changes, we will notify you via SMS or through our website prior to the change taking effect. Continued participation in the program following notice of changes constitutes your acceptance of the updated terms.
12. Limitation of Liability
To the fullest extent permitted by law, Thrive POS and Thrive POS shall not be liable for any delays or failures in the receipt of SMS/RCS messages, as delivery is subject to effective transmission from your mobile carrier. Neither party is liable for any indirect, incidental, or consequential damages arising from your use of or inability to use this messaging service.
13. Governing Law
These SMS Terms shall be governed by and construed in accordance with the laws of the State of TX, without regard to conflict of law provisions.
